Former President Donald Trump has opposed a Department of Justice (DOJ) request for a gag order related to his prosecution. His legal team filed a 25-page brief arguing that such a gag order would infringe on Trump’s freedom of speech and the public’s right to transparency. The brief contends that the government has no authority to limit expression based on its content, subject matter, or message. Special counsel Jack Smith’s team wants to limit Trump’s ability to publicly comment on the case, warning that his inflammatory rhetoric could influence jurors. Trump has also cited the U.S. Constitution to defend himself against efforts to ban him from 2024 presidential primary ballots and to respond to criticisms of his involvement in the Jan. 6, 2021, Capitol protests.
